Charter Terms and Conditions / Privacy Policy
1. General Overview
Swamp Donkey Bowfishing LLC provides guided fishing and bowfishing charters. Participation is voluntary and subject to all rules, policies, and procedures outlined below.
2. Participant Requirements
All participants must be at least twelve (12) years of age.
Participants under eighteen (18) must be accompanied by an adult twenty-one (21) years of age or older.
All participants must follow the captain and crew instructions at all times.
All participants must hold a valid Pennsylvania Fishing License.
All participants must sign a liability waiver before boarding the vessel.
Participants authorize emergency medical assistance if deemed necessary by captain and or crew.
3. Maximum Capacity
Charters are limited to a maximum of four (4) participants, unless otherwise approved.
4. Payment Policy
Full payment is required before the boat leaves the dock.
All accepted payments are by cash or card.
Failure to pay in full will result in cancellation of the trip.
5. Cancellation & Termination Policy
Swamp Donkey Bowfishing LLC reserves the right to cancel, delay, or terminate any charter for any reason, including but not limited to:
Weather conditions
Safety concerns
Mechanical issues
Participant behavior
No refunds will be issued under these circumstances unless otherwise stated in the Weather & Safety Policy below.
6. Weather & Safety Policy
Passenger safety is always the highest priority. The captain closely monitors weather and water conditions before and during every trip. If conditions are deemed unsafe to operate, the charter will be postponed, and guests will have the option to reschedule for another available date or request a refund of their deposit.
At times, weather or river conditions—such as strong winds, heavy rain, or muddy or stained water—may affect fishing quality or shorten the amount of time the trip can safely remain on the water. When these conditions are expected, guests will be notified in advance and given the option to proceed with the scheduled charter or reschedule for a different date.
If guests choose to proceed after being informed of these potential conditions and the boat is launched, the trip will be considered a full charter. Should weather conditions change during the trip and require an early return to the dock for safety reasons, the charter will still be considered completed regardless of the duration of the outing.
7. Safety Rules
Participants must:
Follow all instructions from the captain and crew.
Maintain awareness of surroundings at all times.
Use all equipment safely and responsibly.
Remain on the vessel for the entire duration of the charter and may only disembark at the designated dock, unless otherwise directed by the captain.
Under no circumstances may participants operate or attempt to operate the vessel. Only the captain and authorized crew are permitted to handle or control the boat
Unsafe actions, including but not limited to:
Improper handling and or use of bows.
Not following instructions requested by the captain and or crew.
Unsafe behavior.
May result in immediate removal from the charter without refund.
8. Alcohol, Drugs, & Conduct
Illegal drugs and alcohol are strictly prohibited.
The use of medical marijuana or any substance that may impair a participant’s ability to function safely or follow instructions is also strictly prohibited.
Reckless, unsafe, or disorderly behavior will result in:
Immediate termination of the trip
No refund
9. Equipment Responsibility
Participants are responsible for the proper use of all equipment.
Any lost, stolen, or damaged equipment must be paid for at full replacement cost.
10. Property Damage
Participants are financially responsible for any damage caused to:
The vessel
Equipment
Other boats or property
All repair or replacement costs must be paid by the responsible participant.
11. Legal Compliance
Participants must follow all applicable fishing and boating laws.
Participants are responsible for:
Any fines
Citations
Penalties
This includes violations such as shooting illegal fish.
12. No Guarantee of Catch
Fishing and bowfishing results are not guaranteed.
Payment is required regardless of outcome.
13. Photo & Video Use
Photos and videos may be taken during trips.
These may be used for marketing and promotional purposes, unless participant(s) notify Swamp Donkey Bowfishing before boarding.
14. Privacy Policy
Swamp Donkey Bowfishing LLC respects your privacy and is committed to protecting your personal information.
We may collect personal information from guests during booking or communication, including:

Date of birth

Payment information

Booking and confirming charters
